5. Roles and Responsibilities

KST Director (Sam McManus)

  • Accountable for ensuring that website content is accurate, lawful, and consistent with KST’s governance framework.
  • Responsible for approving and reviewing these Terms of Use.

Website Administrator / Developer

  • Responsible for maintaining the technical operation of the website in accordance with these terms.
  • Implementing access controls, security measures, and content updates as directed by the Director.

Visitors

  • Responsible for reading and complying with these Terms of Use before using the website.
  • Responsible for the accuracy of any information submitted through the website (e.g. contact forms).

10. Record Keeping

  • Terms of Use Versions: All versions of these Terms of Use are retained in the KST document management system with version control.
  • Contact Form Submissions: Enquiries received through the website are retained in accordance with the KST Data Protection Policy and Privacy Notice.
  • Website Change Log: Material changes to website content are recorded by the Director.

Records are stored securely within Google Workspace with access restricted to the Director and authorised personnel.

11. Training Requirements

  • Director: Awareness of website terms, intellectual property obligations, and consumer law requirements. Reviewed annually.
  • Website Administrator / Developer: Understanding of technical requirements for website accessibility, security, and compliance with these terms. Reviewed following any website platform change.

Training completion is recorded in the KST Training Log maintained within Google Workspace.

12. Monitoring and Audit

  • Annual content review: The Director reviews all website content for accuracy, currency, and compliance with these terms at least annually.
  • Terms of Use review: These terms are reviewed annually or following any material change to the website, its functionality, or the legal framework.
  • Incident monitoring: Any complaint, misuse, or legal query relating to the website is recorded and escalated to the Director.

Audit findings and actions are recorded and reported to the Director.

13. Limitation of Liability

To the fullest extent permitted by law, KST excludes all liability for any loss or damage arising from or in connection with the use of the website, including but not limited to:

  • Loss of data, revenue, or anticipated savings.
  • Indirect, consequential, or special loss of any kind.
  • Loss arising from reliance on website content.
  • Loss caused by viruses or other technologically harmful material resulting from use of the website.

Nothing in these terms excludes or limits KST’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

KST’s total aggregate liability in respect of any claims arising from or in connection with the use of the website shall not exceed £100.

14. Review Cycle

These Terms of Use will be reviewed annually or sooner if:

  • Statutory or regulatory guidance changes.
  • The website is materially redesigned, migrated, or its functionality changes.
  • A legal claim, complaint, or regulatory enquiry relates to the website or its content.
  • The Director identifies a need for revision.
